This undertaking is given by you, a member of a staff or Expert group to which a Cernitex Admin has granted access to Restricted Information (you), to Cernitex (Pty) Ltd (registration number 2026/452042/07, Cernitex). It applies in addition to the Cernitex Maps Beta Terms of Use and Privacy Notice. You accept it in the Service before any such access is switched on for you. If you do not accept it, you keep only the layers your groups may see without it.
1. What restricted access is
1.1 A Cernitex Admin may grant a group you belong to access to restricted layers, map by map or by tier. Restricted layers contain personal information about people named in public records or notices, or data whose source terms do not allow it to be shown publicly. Together these are Restricted Information. Owners' names in property records (valuation rolls, deeds) are never shown to any group: they stay with Cernitex's Admins.
1.2 You see Restricted Information on Cernitex's behalf and under its authority, to help Cernitex check, improve and analyse its map. You do not receive it for your own purposes.
1.3 Your access depends on your group membership and on each grant to that group. Cernitex adds you to a group by name, and may change or withdraw a membership or a grant at any time without giving a reason. It records who did so and when. Access is never given to a customer or commercial group.
2. What you undertake
You undertake to Cernitex that you will:
2.1 keep Restricted Information confidential, and not disclose it to anyone except Cernitex's Admins and other members of a group granted the same layer, unless the law requires you to (in which case you will tell Cernitex first, if the law allows);
2.2 use it only for the work described in clause 1.2, and never for your own or anyone else's commercial purposes, marketing, or decisions about any person;
2.3 not copy, export, download, photograph, screenshot, transcribe or otherwise record Restricted Information outside the Service, except as Cernitex asks you to in writing for a specific task;
2.4 not try to identify, contact, profile, track or harass any person named in it, or combine it with other information to do so;
2.5 not let anyone else use your account, see your screen while restricted layers are showing, or use your sign-in;
2.6 keep your devices and sign-in secure, and sign out on any device that is not your own;
2.7 tell Cernitex at once at hello@cernitex.com if you know or suspect that Restricted Information has been seen, copied or disclosed by someone who should not have it, or that your account has been used by someone else; and
2.8 when your restricted access ends, delete anything you hold that contains Restricted Information, and confirm to Cernitex in writing that you have done so.
3. What Cernitex does
3.1 Cernitex logs every request you make to a restricted layer (your account, what was requested, and when) and keeps the log for 90 days. Cernitex may review it at any time to check that this undertaking is kept.
3.2 Cernitex will tell you of any change to the rules for Restricted Information before it applies to you.
4. If the undertaking is broken
4.1 Cernitex may withdraw your restricted access, remove you from any group, and close your account immediately.
4.2 You must make good any loss, claim, fine or cost (including reasonable legal costs) that Cernitex suffers because you broke this undertaking.
4.3 Breaking clause 2 may also be an offence under POPIA or other law, and Cernitex may report it to the Information Regulator or the police.
5. How long it lasts
Your duties in clauses 2.1 to 2.4, 2.8 and 4 continue after your restricted access or your account ends.
6. Law
South African law governs this undertaking.
